In Pennsylvania, what is the difference between a Mechanics LIen and an Enforcemnt of a Civil Judgement?
Q. I had this incompetant Auto repair shop, Bob's Autotorium in Whitaker Pennsylvania, put a new motor in my Dodge Ram. Overpriced, damage to the vehicle and horrible job.. There was a remaining $300.00 on an ending amount of $3,500 which was only to be $2,100 in the beginning. Even though the District Magistrate entered a judgmnt for the amount of $300.00 plus court costs, i refuse to pay it. So, upon doing research as to what rights they have for the enforcement of the Judgement, there is a mechanics lien and a PA Code that relates to the enforcemnt of Judgements which would include a lien or possible sale of property.. Which is it folks? Pennsylvania law is notoriuous for writing contradictory laws, so this is par for the course. … [cont.]

A. There is nothing contradictory. The two concepts relate to two different things. A "mechanic's lien" is a claim against property by someone who was contracted to improve or repair that property. In most states a mechanic's lien against a vehicle allows a mechanic to retain possession of the vehicle until the bill is paid. There are other laws that allow a judgment creditor to enforce collection of his judgment by seizure of property and and its sale by the sheriff or other court officer. The judgment creditor is said to have a judgment lien against the debtor's property until the judgment is satisfied. So, a mechanics lien is against an individual property improved by the mechanic; a judgment lien is against all propoerty of a debtor… [cont.]

What is the time limit for extradition from Pennsylvania to Virginia?
Q. My friend is being held in a jail in Pennsylvania and after his hearing on Wednesday, the state of Virginia will have the right to have him extradited there. They have to pick him up. What is there time limit to pick him up? My friend said it was ten days and after that they would have to file an extension and the max total is 30 days from the day that they are allowed to pick him up.

A. I think that you are confusing the time limit for the action on the detainer with the order for extradition. He is currently held on a detainer for a warrant of extradition and the courts have a limited amount of time to act on that. Since his court date is Wednesday, the time limit on the warrant is a moot point. The amount of time for extradition is generally set by the judge. On average, they will order that the extradition take place within 30 days. Unless a flight is required, he will probably be picked up in15 days. The courts in Pennsylvania will have to notify the Sheriff's Office in Virginia of the court findings for the extradition process. They will probably sit on it for a few days before faxing it out. A. I think the biggest quality was equality; rights for minorities. Native Americans especially. Pennsylvania was also established on Quaker values. It was a religious state that later became secular. EDIT: I KNOW history is not black and white like that, Sean. I don't need to be told that it's not that PC.
